Terms of Service Golden Grip

1. General

1.1 These Terms of Service (“Terms”) apply to the use of www.goldengrip.com (“Website”) and to all offers, orders, and agreements between Golden Grip and its customers (“Customer”).
1.2 By visiting the Website, placing an order, or otherwise using our services, you agree to these Terms. If you do not agree, please do not use the Website.

2. Definitions

• Golden Grip B.V.: the legal entity that owns the Website and offers the products.

• Customer: any natural person or legal entity who visits the Website or makes purchases through the Website.

• Agreement: the agreement between Golden Grip and the Customer regarding the delivery of products and/or services.

3. Use of the Website

3.1 It is prohibited to use the Website for illegal or unauthorized purposes.
3.2 You must comply with all applicable laws and regulations.
3.3 Golden Grip reserves the right to refuse or terminate access to the Website without prior notice.

4. Orders and Agreement

4.1 By placing an order, the Customer makes an offer to purchase the relevant product.
4.2 Golden Grip reserves the right to refuse or cancel an order without stating reasons.
4.3 The Agreement is concluded as soon as Golden Grip confirms the order.

5. Prices and Payment

5.1 All prices are shown including VAT unless otherwise stated.
5.2 Payment must be made via the payment methods accepted by Golden Grip.
5.3 Golden Grip reserves the right to change prices without prior notice.

6. Delivery

6.1 Golden Grip strives to deliver orders within the indicated period but cannot guarantee delivery times.
6.2 Delivery takes place at the address provided by the Customer.
6.3 The risk of loss or damage to the product passes to the Customer upon delivery.

7. Right of Withdrawal / Returns

7.1 Consumers have the right to cancel an order within 14 days of receipt without giving reasons.
7.2 Returns must be made in original condition and packaging.
7.3 Different rules may apply for non-consumers; please refer to our return policy.

8. Intellectual Property

8.1 All intellectual property rights on the Website, its content, and products belong to Golden Grip or its licensors.
8.2 It is prohibited to copy, distribute, or otherwise use content from the Website without written permission from Golden Grip.

9. Privacy and Data Protection

9.1 Golden Grip processes personal data in accordance with applicable privacy laws and our Privacy Policy.
9.2 By using the Website, you agree to the processing of your data as described in our Privacy Policy.

10. Liability

10.1 Golden Grip is not liable for damages resulting from the use of the Website, except in cases of intent or gross negligence.
10.2 Liability for indirect damages, consequential damages, or loss of profits is excluded.
10.3 Golden Grip is not responsible for the content or availability of third-party websites linked from the Website.
10.4 The use of Golden Grip products involves inherent risks of physical injury. By purchasing, the Customer expressly assumes these risks and agrees to use the products only as intended. Golden Grip is not liable for injuries resulting from improper use or overexertion.
10.5 Equipment sold on our website includes equipment that would be used for high-risk activities, like weight training, armwrestling, strongman, and climbing. Using our products for these types of activities provides inherent risk to injury, irrespective of the functioning of our equipment. By using our equipment for any activities related to weight training, armwrestling, strongman, climbing, or other strength-related activities you assume full responsibility over the risk involved in this, including death, and severe personal injuries. Customer acknowledges that they have been advised to consult a physician before beginning any high-intensity strength training. Golden Grip B.V. is not liable for any financial compensation of any kind for any type of injury that occurs while using our equipment during the participation in any of the activities outlined above. 
10.6 IN NO EVENT SHALL GOLDEN GRIP’S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY THE CUSTOMER FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM, OR $100, WHICHEVER IS GREATER.
10.7 EXCEPT AS EXPRESSLY PROVIDED HEREIN, THE PRODUCTS ARE PROVIDED 'AS IS'. GOLDEN GRIP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

11. Changes to Terms

11.1 Golden Grip reserves the right to modify these Terms.
11.2 Modified terms will be published on the Website and will apply from the date of publication.

12. Governing Law and Disputes

12.1 All agreements between Golden Grip and the Customer are governed by Dutch law.
12.2 Disputes will be exclusively submitted to the competent court in the Netherlands.
12.3 NO CLASS ACTIONS: The Customer agrees that any dispute resolution proceedings will be conducted only on an individual basis and not as part of any class, consolidated, or representative action.
12.4 WAIVER OF JURY TRIAL: to the fullest extent permitted by law, the Customer waives any right to a trial by jury in any legal proceeding arising out of or relating to the use of Golden Grip products or services.
